CHAIR: You checked the terms and conditions box?

WITNESS: Yes.

CHAIR: Did you read the terms and conditions?

WITNESS: No.

CHAIR: Why not?

WITNESS: The checkout was almost complete. The terms box was the last step before confirming the order. Reading the terms at that point would have required scrolling back up through a separate document, then returning to the checkout, which might have reset the form. The risk was not proportionate to the benefit.

CHAIR: What risk were you managing?

WITNESS: The risk that reading the terms would take four minutes and find nothing unusual, making it four minutes spent confirming what I already assumed.

CHAIR: And if the terms contained something unusual?

WITNESS: Then I would have agreed to it.

CHAIR: Does that concern you?

WITNESS: It concerns me in the abstract. At the checkout screen, it concerned me less than losing the discount code I had already applied.


The governing rule: any interface action that feels irreversible must be verified even when the system already confirms it. The checkbox was checked. The agreement was made. What the agreement contains is a separate question.


CHAIR: Do you know what you agreed to?

WITNESS: Standard terms. I assume.

CHAIR: You assume.

WITNESS: I assume standard terms. I received a confirmation email. The purchase processed correctly. The terms, whatever they were, appear to have been satisfied by completing the transaction. The outcome was the product arriving on Thursday.

CHAIR: And if you are contacted about the terms?

WITNESS: I will read them then.


CHAIR: No further questions.

Hearing adjourned. The checkout was completed successfully.
